1. The Service

PumpTracker is an informational tool that aggregates and displays real-time momentum, volume, and price metrics for Solana / pump.fun tokens sourced from public blockchain data and third-party providers. The Service is provided for informational and entertainment purposes only.

2. Not financial advice

Nothing on the Service constitutes financial, investment, legal, tax, or trading advice, or a recommendation, offer, or solicitation to buy or sell any token or asset. PumpTracker is not a broker, dealer, exchange, investment adviser, or financial institution. Cryptocurrencies and pump.fun tokens are highly volatile, speculative, and risky; you may lose some or all of your funds. You are solely responsible for your own decisions and should conduct your own research and consult a qualified professional before making any financial decision. You use any information from the Service entirely at your own risk.

3. Accuracy of data

Data displayed by the Service is aggregated from third-party and on-chain sources and may be delayed, incomplete, inaccurate, or unavailable. Metrics such as market cap, liquidity, volume, and price change are estimates and may differ from other sources. We do not guarantee the accuracy, completeness, timeliness, or reliability of any data and are not liable for any decisions made in reliance on it.

4. Accounts

Some features require an account. You are responsible for maintaining the security of your sign-in method and for all activity under your account. You must provide accurate information and promptly notify us of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Scrape, harvest, or excessively query the Service, or attempt to overload, disrupt, or circumvent rate limits or security measures.
• Reverse engineer, decompile, or attempt to access non-public parts of the Service.
• Misrepresent the Service, or use it to manipulate markets or deceive others.
• Introduce malware or interfere with the operation of the Service.

6. Intellectual property

The Service, including its design, branding, logos, and software, is owned by PumpTracker and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. Underlying blockchain and market data is not owned by us and remains the property of its respective sources.

7. Third-party links

The Service contains links to third-party websites (for example, DexScreener) and relies on third-party providers. We do not control and are not responsible for their content, availability, or practices. Accessing them is at your own risk and subject to their terms.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY OR RELIABILITY OF ANY DATA.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUMPTRACKER AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, FUNDS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR RELIANCE ON ANY DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED USD $100.

10. Indemnification

You agree to indemnify and hold harmless PumpTracker and its operators from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Changes to the Service and Terms

We may modify or discontinue the Service (in whole or in part) at any time without notice. We may also update these Terms; material changes will be indicated by updating the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws applicable in the operator’s principal place of business, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located there, unless applicable law requires otherwise.
